1. Website disclaimer
General information only
The content of this website is provided for general information about our services. It does not constitute construction, structural, architectural, planning, surveying, legal, insurance or financial advice, and must not be relied upon as such. You should always obtain advice specific to your property and circumstances from a suitably qualified professional before making decisions or committing expenditure.
No offer or contract
Nothing on this website is an offer capable of acceptance. Indicative prices, budget ranges, timescales and specifications are illustrative only. A binding agreement arises only where we issue a written quotation following a site survey and that quotation is accepted in writing, subject to our terms of business.
Imagery and project examples
Images on this website may include architectural visualisations, reference imagery and representative examples of the types of work we carry out. They are not necessarily photographs of specific completed contracts, and finishes, materials and layouts shown may differ from what is achievable or specified for your project.
Statutory approvals
Planning permission, permitted development rights, building control approval, listed building consent, party wall awards and similar approvals are granted by local authorities, approved inspectors and other third parties. We can coordinate applications and build to approved drawings, but we do not grant approvals and cannot guarantee that any application will succeed or that any particular timescale will be met.
Accuracy and availability
We take reasonable care to keep this website accurate and current, but we make no warranty that it is complete, error-free or continuously available. We may change, suspend or withdraw any part of it without notice.
External links and third parties
This website links to third-party platforms, including Instagram, WhatsApp, Telegram and Checkatrade. We are not responsible for the content, availability, terms or privacy practices of those platforms, and a link does not imply endorsement of anything else found there.
Limitation of liability
To the fullest extent permitted by law, we exclude liability for any loss or damage arising from reliance on the content of this website, including indirect or consequential loss, loss of profit and loss of opportunity. Nothing in this disclaimer excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded. Liability under any construction contract is governed by that contract, not by this website.
2. Terms of business
These terms summarise how we contract. The full terms attached to your written quotation take precedence over this summary.
- Scope: the works are limited to what is itemised in the accepted quotation. Anything not listed is excluded, including items shown on drawings but not priced.
- Variations: changes to the scope are priced in writing and must be agreed before they are carried out. Verbal instructions on site are confirmed in writing before they take effect.
- Provisional sums: where an allowance is stated as provisional, the final cost is reconciled against actual cost and evidenced with supplier documentation.
- Programme: start and completion dates are estimates given in good faith. They may be adjusted for weather, statutory approvals, material lead times, unforeseen ground or structural conditions, or client-instructed changes.
- Payments: invoiced in stages against completed work, payable within the period stated on the invoice. A retention may be held until snagging is signed off.
- Late payment: overdue sums may attract statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998 where that Act applies, and we may suspend works after giving written notice.
- Access and services: you agree to provide safe access to the site and reasonable use of water and electricity unless otherwise agreed in the quotation.
- Existing conditions: we are not responsible for pre-existing defects, latent structural defects, asbestos, contamination or non-compliant prior works that were not reasonably detectable at survey. Where such matters are discovered, work in that area stops and is repriced.
- Title and risk: materials remain our property until paid for in full; risk in the works passes as set out in the contract.
- Subcontracting: we may engage vetted specialist subcontractors and remain responsible to you for their work under the contract.
3. Quotations & pricing
- Any site-visit fee and the terms of the quotation are confirmed before a visit is booked.
- Each quotation states its scope, exclusions, pricing basis and validity period.
- Any figure given verbally, by phone or messaging app, or before a survey, is an estimate only and is not binding on either party.
- Quotations state clearly whether VAT is included, excluded or not applicable. Certain residential works may qualify for reduced or zero VAT rating under HMRC rules; eligibility is determined by HMRC, not by us.
- Where a design changes after acceptance, or approvals impose additional requirements, the price is revised in writing before those works proceed.
4. Guarantees & warranties
- Our workmanship is guaranteed for the period stated in your contract, running from the date of practical completion.
- Manufacturer warranties on materials, appliances and installed products are passed to you at handover and are subject to the manufacturer’s own terms and registration requirements.
- Guarantees do not cover fair wear and tear, accidental or malicious damage, misuse, lack of maintenance, movement or defects in the existing structure, works altered or repaired by others, or damage caused by extreme weather or events outside our control.
- Guarantee cover is conditional on the account being paid in full.
- To make a claim, contact us in writing with photographs and a description of the issue. We will inspect within a reasonable period and, where the claim is valid, remedy the defect at our cost.
- Your statutory rights, including those under the Consumer Rights Act 2015 where you contract as a consumer, are not affected.
5. Insurance & compliance
- Project insurance: the insurance certificates, policy limits and any contract-works cover applicable to a project are confirmed in the quotation or contract before work begins.
- Your insurer: property owners should notify their buildings insurer before structural or material alteration works start.
- Specialist work: any trade registrations and certification required for notifiable gas or electrical work are identified in the project documentation.
- Building regulations: responsibility for notifications, inspections and completion documents is agreed for each project before work begins.
6. Health & safety
We work in accordance with the Construction (Design and Management) Regulations 2015 and applicable health and safety legislation. On domestic projects, duties that would otherwise fall to the client normally pass to the contractor or principal contractor.
- Site-specific risk assessments and method statements are prepared where the work requires them.
- Site areas are separated from occupied areas, and access by children, pets and visitors is restricted while works are in progress.
- Suspected asbestos-containing materials are not disturbed; work stops and a licensed specialist is instructed where required.
- Working hours are agreed with you and comply with any restrictions imposed by the local authority or your lease.
7. Privacy notice
Azar Construction Ltd is the data controller for personal data collected through this website. We process personal data in accordance with the UK GDPR and the Data Protection Act 2018.
What we collect
- Details you submit through the enquiry form: name, telephone number, email address, site postcode, type of work, optional budget range and your message.
- Details you provide by phone, email, WhatsApp or Telegram in the course of an enquiry or contract.
- Project information such as photographs, drawings and specifications you send us.
- Basic technical data collected by our hosting provider, such as IP address and browser type, for security and reliability purposes.
Why we use it, and our lawful basis
- To respond to your enquiry and prepare a quotation — steps taken at your request prior to entering a contract.
- To perform a contract — managing the works, invoicing, warranties and aftercare.
- To meet legal obligations — accounting, tax, health and safety and building control records.
- Legitimate interests — keeping records of enquiries, defending claims and improving our service, balanced against your rights.
Who we share it with
Only where necessary: structural engineers, architects, surveyors, building control bodies, specialist subcontractors and suppliers working on your project; our accountants and insurers; and our IT, hosting and email providers. We do not sell personal data or share it for third-party marketing.
How long we keep it
Unsuccessful enquiries are kept for up to 24 months. Contract and financial records are kept for at least six years after completion to meet statutory and limitation requirements, and longer where a guarantee or claim makes that necessary.
Your rights
You have the right to access your personal data, and to request correction, erasure, restriction or portability, and to object to processing based on legitimate interests. Where processing is based on consent, you may withdraw it at any time. Contact info@azarconstructions.co.uk to exercise these rights. If you are not satisfied with our response, you may complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113.
Messaging platforms
When you contact us via WhatsApp, Telegram or Instagram, your message is also processed by that platform under its own privacy policy, which we do not control.
8. Cookie notice
This website does not set advertising or tracking cookies and does not run analytics profiling by default. Fonts are loaded from Google Fonts, which means your browser makes a request to Google’s servers and your IP address is visible to Google as part of delivering those files.
- Strictly necessary cookies may be set by the hosting platform for security and load balancing.
- If analytics or marketing cookies are added later, a consent banner will be introduced and this notice updated first.
- You can block or delete cookies through your browser settings; strictly necessary cookies cannot be disabled without affecting site function.
9. Complaints procedure
- Step 1 — tell us. Raise the issue with your site manager, or email info@azarconstructions.co.uk with the site address and a description. We acknowledge complaints within 5 working days.
- Step 2 — inspection. Where the complaint concerns the works, we arrange an inspection at a time convenient to you, normally within 14 days.
- Step 3 — written response. We set out our findings, what we will do and by when, normally within 28 days of acknowledgement.
- Step 4 — escalation. If you remain dissatisfied, you may escalate to a director, and thereafter to independent mediation or adjudication. Consumers may also seek advice from Citizens Advice on 0808 223 1133.
10. Cancellation rights
Where you contract as a consumer and the contract is concluded away from our business premises or at a distance, you generally have 14 days from the date of the contract to cancel without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Your cancellation rights and the method of cancelling are set out in your quotation pack.
- If you ask us to start work within the 14-day period, you may be required to pay for work carried out and materials ordered up to the point of cancellation.
- Bespoke or made-to-measure items may be non-cancellable once production has begun.
- Cancellations after works have commenced are dealt with under the termination provisions of your contract.
11. Intellectual property
